The right to own a gun. A new showdown now over one of America’s longest ever legal battles. The new Supreme Court term hasn’t started yet and yet the court announced today they’re going to take a case and decide whether state and local laws outlawing guns violate the second amendment헌법수정 2 to the federal constitution. Our justice correspondent Pete Williams is outside the court tonight with more on this. Pete? Good evening.

 

Brian? Just a year ago, the court said that the second amendment guarantees the right to keep a gun at home for self defense here in Washington DC. Now the question is, does that same right apply nationwide? The court agreed today to take up a challenge brought by residents of Chicago who oppose that city’s ban on handguns. A year ago, the court struck down an equally strict handgun ban in Washington DC ruling that it violated the second amendment right to bear arms. That right, the court said, prevented Washington from banning the type of firearm most commonly used in America for self defense at home.

 

But the court’s ruling was limited declaring that the second amendment was a protection against the federal restriction on gun ownership. That applied to Washington because the District of Columbia is a federal city. Now gun rights advocates say they’re hoping the court will use the Chicago case to apply the second amendment right nationwide. “Well, I have every confidence that the Supreme Court is going to say that this is a freedom to be enjoyed by the entire American people not just those in federal enclaves영토.”

 

If the court says the second amendment prevents cities and states from banning handguns, such a ruling would also endanger New York City’s strict handgun limits. But it would almost certainly invite challenges to other laws limiting firearms like state laws or city ordinances법령 against having guns outsid the home or carrying concealed weapons, though gun control advocates say it would not automatically mean the end of those laws.
